WWE has dealt with more than its fair share of lawsuits, especially within the last year. Vince McMahon has personally been dealing with multiple lawsuits, some of which came from women who allege he sexually assaulted them, and others coming from WWE shareholders.
RELATED: Roman Reigns Has Been A World Champion In WWE More Days Than John CenaUnfortunately, the legal troubles don't seem to be slowing down for the WWE. The company has been hit with another lawsuit, this one coming from a fan who attended Wrestlemania 38 last year.
Fan Suing WWE Over Pyrotechnics-Related Hearing Loss
A lawsuit filed on January 12th in the District Court of Tarrant County, Texas, by plaintiff Marvin Jackson alleges that Jackson lost almost all of his hearing in his left ear due to a pyro blast that was part of Wrestlemania 38.
The lawsuit alleges that not only was the blast “so loud that it caused Plaintiff to lose almost all hearing in his left ear,” but also that WWE “failed to notify anyone or place any warnings.” In addition, the lawsuit claims that the plaintiff "was injured as a result of the objective, extreme risk that [WWE] was subjectively aware of yet disregarded for cosmetic effect and pecuniary gain."
Lastly, the plaintiff claims that WWE "is strictly liable for Plaintiff’s injuries arising from the pyrotechnic display because the use of pyrotechnics indoors constitutes an “abnormally dangerous activity” for the purposes of the common law rule that a party carrying on an abnormally dangerous activity is strictly liable for the damages caused thereby."
It is on account of these claims that the plaintiff is accusing WWE of Negligence, Gross Negligence, and Strict Liability.
The lawsuit is seeking a trial by jury on all claims and about $1 million in compensation, including “damages of any kind, penalties, costs, expenses, prejudgment interest, and attorney’s fees.”
